The amendment of section 25 of the Constitution threatens the property rights of all citizens of the country. The amendment will establish the principle where expropriation of immovable property is possible for purposes of land reform with no compensation.

Stop die wysiging van die Grondwet

Die wysiging van artikel 25 van die Grondwet bedreig alle landburgers se eiendomsreg. Die wysiging sal die beginsel vestig waar onteiening van onroerende eiendom vir doeleindes van grondhervorming met geen vergoeding moontlik is.

    Hiermee wil ek my teenkanting ten opsigte van die wysiging van artikel 25 van die grondwetwysiging uitspreek. Ek ondersteun Vrystaat Landbou se voorlegging en pogings om die grondwetwysing te stop.

      Protect your property rights

      I hereby wish to express my opposition to the amendment of section 25 of the Constitution. I support Free State Agriculture's submission and efforts to stop the constitutional amendment.

      I agree to the provisions set out in Free State Agriculture's privacy policy.

      “Property rights are inextricably part of human rights, and no state has the right to alienate people from it.” This is the viewpoint of Free State Agriculture President, Francois Wilken, after the Constitution Eighteenth Amendment Bill, 2021, was published for public comment.

      The Constitution Eighteenth Amendment Bill will enable the state to expropriate any land and its improvements for purposes of land reform without compensation.

      According to Wilken, the adoption of this amendment will represent a watershed in the constitutional order of the country. This change will establish the principle that a citizen’s property can be expropriated by the state without compensation. It is an injustice.

      Arguments that owners will be protected from exploitation by laws, restrictions and processes do not hold water. “Irrespective of the risks established by the corrupt and falling state administration, property rights are a matter of principle and not a procedural matter. We need to protect it at all costs,” Wilken said.

      Free State Agriculture will therefore oppose the constitutional amendment during the public participation processes and, if necessary, do everything legally possible to stop the amendment.

      “Eiendomsreg is onlosmaaklik deel van menseregte en geen staat het die reg om mense daarvan te vervreem nie.” Dit is die standpunt van Vrystaat Landbou president, Francois Wilken, nadat die agtiende wysigingswetsontwerp op die Grondwet, 2021, vir openbare kommentaar gepubliseer is.

      Die agtiende wysigingswetsontwerp op die Grondwet sal dit vir die staat moontlik maak om enige grond en die verbeterings daarop vir doeleindes van grondhervorming te onteien sonder vergoeding.

      Volgens Wilken sal die aanvaarding van hierdie wysiging ʼn waterskeiding in die grondwetlike bestel van die land verteenwoordig. Hierdie verandering sal die beginsel daarstel dat ʼn landsburger se eiendom deur die staat afgeneem sal kan word sonder vergoeding. Dit is ʼn onreg.

      Argumente dat eienaars deur wette, beperkinge en prosesse teen uitbuiting beskerm sal word, hou nie water nie. “Ongeag die risiko’s wat deur die korrupte en vallende staatsadministrasie daargestel word, is eiendomsreg ʼn beginselsaak en nie ʼn prosedurele aangeleentheid nie. Ons moet dit ten alle koste beskerm,” het Wilken gesê.

      Vrystaat Landbou sal daarom die grondwetwysiging gedurende die openbare deelnameprosesse teenstaan en, indien nodig, alles wetlik moontlik doen om die wysiging te stop.
