The new Expropriation Act remains the biggest threat to the property rights of every citizen, warns Free State Agriculture (FSA).

According to Francois Wilken, President of Free State Agriculture, it is important that citizens and civil organizations do not see the repulsion of attempts to amend the Constitution as the end of the attack on property rights. “Unlike the amendment to section 25 of the Constitution, the new Expropriation Bill of 2020 envisages being able to expropriate all assets (not just land). With the Constitution Amendment Bill, a two-thirds majority was required for approval. On the other hand, only an absolute majority (50% + 1) of votes is required for the Expropriation Bill”.

The finalization of the Expropriation Bill 2020 is still in process and for the time being the public participation process has been completed, there may be further participation later in the year when the National Council of Provinces (NCOP) reflects on the Bill.

Free State Agriculture expects the bill to be finalized with urgency by parliament in 2022.

Free State Agriculture is opposed to the newly proposed Expropriation Act for the following reasons:

  1. All assets can be targeted by the state for expropriation.
  2. Expropriation can take place under the undefined term of Public interest.
  3. Only at a large cost can the victim of expropriation defend themselves against expropriation in court.
  4. The law is a back door for expropriation without compensation.

“Globally, expropriation is a mechanism for the development of national infrastructure and services. The new expropriation law aims to be an instrument of redistribution: redistribution of hard-earned assets from citizens to corrupt political elites.” means Wilken.

“This radical political ideology has had a huge impact on our economic growth as a country. If we had backed down and not opposed the ruling party’s motion, South Africa would certainly have been in a much worse position.”

Die nuwe Onteieningswet bly steeds die grootste bedreiging vir die eiendomsreg van elke landsburger, waarsku Vrystaat Landbou (VL).

Volgens Francois Wilken, President van Vrystaat Landbou, is dit belangrik dat landburgers en burgerlike organisasies nie die afwering van pogings om die Grondwet te wysig as die einde van die aanval op eiendomsreg sal sien nie. “Anders as die wysiging van artikel 25 van die Grondwet, stel die nuwe Onteieningswetsontwerp van 2020 dit in die vooruitsig om alle bates (nie net grond nie) te kan onteien. Met die Grondwetwysiging-wetsontwerp was ʼn twee derde meerderheid nodig vir goedkeuring. Daarteenoor is slegs ʼn volstrekte meerderheid (50%+1) van stemme vir die Onteieningswetsontwerp nodig”.

Die finalisering van die Onteieningswetsontwerp 2020 is nog in proses en voorlopig is die openbare deelnameproses afgehandel, daar kan later in die jaar verdere deelname wees wanneer die Nasionale Raad van Provinsies (NCOP) oor die Wetsontwerp besin.

Vrystaat Landbou verwag dat die wetsontwerp met dringendheid in 2022 deur die parlement gefinaliseer sal word.

Vrystaat Landbou is gekant teen die nuut voorgestelde Onteieningswet om die volgende redes:

  1. Alle bates kan deur die staat vir onteiening geteiken word.
  2. Onteiening kan plaasvind onder die ongedefinieërde term van Publieke belang (Public interest).
  3. Slegs teen ʼn groot koste kan die slagoffer van onteiening hulself teen onteiening in die hof verdedig.
  4. Die wet is ʼn agterdeur vir onteiening sonder vergoeding

“Wêreldwyd is onteiening ʼn meganisme vir die ontwikkeling van nasionale infrastruktuur en dienste. Die nuwe onteieningswet beoog om eerder ʼn instrument van herverdeling te wees: herverdeling van hardverdiende bates vanaf landsburgers na korrupte politieke elite.” meen Wilken.
